A publisher approached us, as they were keen to publish a particular game. However they were concerned with potential similarities to a well known Disney owned IP.
They asked whether we could arrange for insurance for the developer, to protect them in the event that Disney sued for copyright infringement.
We worked with the developer and analysed the risks, in particular the Copyright Term Extension Act, 1998, and presented an objective case to our insurers – highlighting (not hiding) the risks.
Based on our submission, insurers were happy that the risk was acceptable and came up with a fair price and offered a policy to protect the developer in the event Disney sued on copyright grounds.
This then gave the publisher sufficient confidence to proceed with the publishing deal.
